Overview

The Wake County Department of Tax Administration dockets foreclosure judgments with the court system for unpaid property taxes on real estate. This is a preliminary step to selling the property at public auction for satisfaction of the tax lien. The judgment is docketed 30 days after the property owner is notified either by certified mail or publication.

To prevent the foreclosure process, the delinquent taxes, including interest and costs, may be paid before the judgment is docketed or at any time thereafter, as allowed by law.

North Carolina does not sell tax lien certificates; therefore, payment of the tax lien prior to sale at public auction will not transfer ownership of the property.

Sale at Auction

Sales at public auction are executed by the Sheriff’s Office approximately four months after a judgment is docketed. Notice of the sale is advertised in The News & Observer and posted on the bulletin board inside the Salisbury Street entrance of the Wake County Courthouse 20 days prior to the auction date. The sale date information displayed on this Web page is updated as it is received from the Sheriff’s Office.

Sales are conducted inside the Salisbury Street entrance of the Wake County Courthouse on the scheduled day of the auction, unless otherwise noted. The successful bidder at this sale is required to make a cash deposit of 10% of the bid.

Upset Bids

Successful bids lie open for a 10-day period to allow for the submission of upset bids. The minimum amount accepted for an upset bid is 5% of the original bid amount, or $750, whichever is greater. Upset bids are made with the Clerk of Superior Court, located on the 1st Floor of the Wake County Courthouse. Information regarding bid status is not provided over the telephone.

In the event the successful bidder refuses to accept the deed and honor the bid, the deposit will be forfeited and applied toward defraying costs and expenses. This in no way restricts or limits any other remedies that may be available against a defaulting bidder.

Other Foreclosures

The Clerk of Superior Court's Special Proceedings Division also maintains a listing of properties scheduled for foreclosure by Deed of Trust holders. These foreclosures are not related to property tax and are not handled by the Wake County Department of Tax Administration. Please visit the State's website for more information.
